Locally, Dunmore's plansx include new projects in southSacramento County, includintg a sizable transit-oriented development proposed next to the planneed Morrison Creek light-rail station and 4,0090 new homes near Elk Grove on land that Dunmorre acquired in its foray as a land developer. The $70.5 million budget approved Wednesdayuby CDTA’s board of directors boosts fares to from $1, beginning April 1, the startg of the fiscal year. A hike in fares, increaserd parking rates at the Albany-Rensselaer station and service reductions were necessary to help closea $5 million shortfall, said Ray CDTA’s executive director. Why was this section included inour constitution? Section 93 was brought forward from the 1875 Constitution which was adoptesd to “redeem” the state from reconstruction and to address the desperate economic conditiones that existed then. Also, remember that in 1901 theree wereno automobiles, roads were unpaved, transportation was either by train or horse and buggy and there was littlre interest in public improvements.
The restrictionw of these provisions led to a host of constitutional amendments to allow the state to build roads and to authorize the state dockxsat Mobile; to build hospitals and treatmeny centers; to construct buildings at universities and public schools; to develop inland docks; to constructr a system of state parks; to support publifc libraries and to provide economic development incentives. Over the years, literall y hundreds of amendments have been adopted so as to allowq the state to engage in these important publifcimprovement projects. Simply stated, the 1901 Constitutionh was inadequate to deal with the realities of the 20th centurt not to mention our worldof 2008.
Its prohibitions were so narroqw and restrictive that state and loca governments could not meet the needs ofthe state. Of the over 800 almost half were adopted to relieves the restrictions ofSection 93. The effect of the restrictions of the 1901 Constitutionj were dramatically illustrated when made its decisio n to locate a manufacturing facility in Tuscaloosa An important factor in its decisiohn were commitments to incentives made bystate leaders. Imagine theitr chagrin when they discovered that constitutional issue about the validity of the commitments existex because of the restriction ofSection 93.

National Union seeks a judge'xs ruling that it does not have to compensate Reichholdx for damages resulting fromtwo lawsuits. Reichhold argues in court filings that the insurance company does owe it indemnituy in relation to coverage for those suitss and other pending oranticipated claims. Reichhold spokeswomamn Cris Masselle declined to commenty onthe case, and Reichhold CEO John Gaithefr was unavailable for National Union is an affiliated company of America International Group, or AIG.
Michael Arcaro, a spokesman for AIG, was similarlyt tightlipped. "Our policy is not to comment onongoingh litigation," says Arcaro. The two underlyin g lawsuits in question trace their origins to litigation betweenj Reichhold andPompano Beach, Fla.-based Nebula Glasd International, which does businessz as Glasslam. Reichhold manufactured resin materialfor Glasslam, whicnh develops glass laminating resins that it sells to manufacturers of safetty and hurricane-resistant glass, from 1996 to 2001.
Glasslamj in 2002 filed a lawsuit againstr Reichhold claiming that the Durham company had altered the chemicak makeup of a resin it was producing forGlasslamm - a change that Glasslam allegesd caused the product to fail. For in some cases, it caused the glass to turn yellowwor delaminate. Glasslam won a $22.65 million verdict in a federal court in southern Floridaz against Reichhold inJune 2004. The judgment was affirmef on appeal, and court documents filed by Reichhold show that National Uniob eventually paid morethan $19.5 millionm to help satisfy the A second, similar case filec by Glasslam against Reichhols was settled for an undisclosed amount in December 2005.
That complainy claimed that Glasslam had suffered additionapl damages of morethan $15 million. Reichhold was joined as a third-parthy defendant by Glasslam in Januaryg 2006 in another lawsuit originally filed against Glasslan by one of its customersnamed Jeld-Wen Inc.
