The lawsuit, which is seeking class-action filed against Dallas-based Match.com was filed by Sean McGinnm of Brooklyn, N.Y., on behalf of other Match.cokm users or former users impactede bythe company’s allegeds actions. In the suit, the plaintiffv accuses Match.com of keeping the profiles of canceleemembers online, despite the fact thos e members had suspended their memberships and cannot respond to e-mails from other Match.com users. The suit alleges that the majorith of Match members are actuall y canceled subscribers or never subscribedat all.
Subscribers profiles remain online evenafter they've canceled their subscription, and that is not made cleart in the user agreement, according to the suit. “Matc h misleads paying subscribers by charging them for the abilituy towrite e-mails to memberss who can’t reply to their e-mailws or even read them,” said the lawsuit, which was filed in New York state. Match.com respondexd to the allegations, releasing a statementt saying: "While we only just receivef the complaint, we believe this lawsuirt is without merit, and we will defencd it vigorously. Match.
